Everyone in the country has heard of Trayvon Martin and George Zimmerman but few know the name of Trevor Dooley-a central Florida man who shot and killed a neighbor and is defending himself using Florida’s Stand Your Ground law.  The Dooley shooting has a number of similarities with the Zimmerman shooting but has not been the subject of the mainstream media meltdown nor the focus of cries of racism, even though the shooter and the victim were both of different races.

One of the central charges of racism in the case that there was unequal justice applied in the case of “white Hispanic” George Zimmerman, because Zimmerman was allowed to go free. Trevor Dooley, however, is black and critics of the authorities’ handling of the Zimmerman case will doubtlessly point out that Dooley was, in fact, arrested and charged in his shooting case.

As a diarist on liberal website Daily Kos said in a piece on the Dooley shooting written before Zimmerman was charged.
Now we see what happens when a Black Man kills a White Man then asserts “Self Defense”.  He has to prove it.  Other people in the opposite situation, not so much.
This argument ignores a couple of important facts about the Zimmerman and Dooley cases. Like Zimmerman Dooley was initially released by the police. As an article in the Tampa Bay Times explains:

Trevor Dooley walked out of his suburban house Sunday afternoon, past his trimmed lawn and nice landscaping, to confront a boy riding a skateboard on the basketball court across the street. That’s against the rules in this neighborhood, and Dooley, 69, was carrying a gun.

David James, 41, with 20 years in the Air Force, was playing basketball with his 8-year-old daughter. They played every Sunday.

James stood up for the skateboarder, neighbors said. The men argued and got into a “physical confrontation,” the Hillsborough County Sheriff’s Office said.

Then, in front of his daughter, James was shot dead.

What authorities don’t know is who pulled the trigger, or whether it was justified.

The Sheriff’s Office has not named Dooley as a suspect or charged him with a crime. When police arrived around 4 p.m., he was waiting with the dead man. He invoked his right to remain silent and called his lawyer.

“We haven’t named him yet as a suspect. I’m not going to say he’s not,” said sheriff’s Col. Albert Frost. “We have various witnesses and various conflicting statements at this point to start with. Obviously, that doesn’t help us. We’re trying to sort out the facts and trying to determine what really happened.”

So Dooley went back to work Monday morning, driving a school bus loaded with kids.


This did not result in demonstrations or national media coverage. Joe Biden did not step out into the Rose Garden of the White House and say that David James looked like the son Biden could have had. Instead, a local crime played itself out locally.

Another major difference between Zimmerman and Dooley is hinted at in the Times article; Dooley steadfastly refused to To cooperate or even speak with law enforcement whereas George Zimmerman has been repeatedly described as being very cooperative with investigators.

Furthermore, could be pointed out that Zimmerman was charged with second-degree murder whereas Mr. Dooley was charged with manslaughter. As the Tampa Bay Times points out in the Dooley case:

Just last Friday, Dooley’s lawyers were in court making their case. According to this article in the Times.


Trevor Dooley’s lawyers say it was an act of self-defense — pulling the trigger kept him alive.

David James was on top of him, hands around Dooley’s neck. Dooley couldn’t breathe. He tried to warn James by poking him in the leg twice with a handgun.

When it didn’t work, Dooley fired.

Lawyers for Dooley, the man accused of killing his Valrico neighbor, submitted their argument Thursday in a motion asking a judge to dismiss the manslaughter charge against him.

Black Activist to Trayvon's Parents: 'Get Off the Stage' and Let Us Politicise His Death

 

A well-known, mainstream media-vetted college professor named Dr. Boyce Watkins states that it’s time for Trayvon Martin’s parents to “step to the side,” out of an apparent fear that “being honest” could negatively affect the race-baiting political agenda that Obama allies like Al Sharpton have carefully crafted. 

Dr. Watkin’s stark admonishment, “Get her off the stage right now,“ came in a recent blog post that shows the goal of the politicization of the Martin shooting is not truth or justice.

Who is Dr. Boyce Watkins? He’s a professor at Syracuse University and his website shows that he’s been a frequent guest on cable news shows, including CNN’s Anderson Cooper 360 and MSNBC’s Keith Olbermann. He is also a frequent speaker on black issues, and his site shows his speeches have earned high praise from well-known leaders of the resentment-driven civil rights movement, including Al Sharpton, Jesse Jackson, and Michael Eric Dyson.
In his bluntly-titled article, Note to Trayvon’s Mother: It’s Time for You to Step to the Side, Dr. Watkins referred to the recent Today Show appearance by Trayvon Masrtin’s mother where she said:
One of the things that I still believe in, a person should apologize when they are actually remorseful for what they’ve done. I believe it was an accident. I believe that it just got out of control and he couldn’t turn the clock back. I would ask him, did he know that that was a minor, that that was a teenager, and that he did not have a weapon?”
Dr. Watkin’s reaction is pretty stunning:
When I heard these words, I froze in my tracks.  I couldn’t believe that Trayvon’s mother would make a statement that was in such stark contradiction to the charges being brought forth by the prosecutor.  In fact, there’s a big part of me that wonders why she was on the show at all.
Note that Dr. Watkins is not concerned with the veracity of the statement but rather how the statement affects the politically motivated prosecution of George Zimmerman. In fact, later in the article Dr. Watkins explicitly says that even if the assessment of the shooting as an accident was honest, it should not of been said.
God bless Sybrina for being honest (if that is what she meant to say), but there are some things better left unsaid.  For the mother of the victim to make a statement in national media that directly contradicts the efforts of the prosecution is nothing short of disastrous.
Which begs the question: disastrous to what? Being honest and telling the truth is certainly not disastrous to the goal of actual justice. However, justice is clearly not the goal of men like Sharpton and Watkins. In fact, as Watkins admits in the final paragraph of this piece, this really isn’t about Trayvon Martin at all. He says:
Trayvon’s parents have done their work and they’ve done it well.  They’ve achieved the first steps toward justice for their son, and now it’s time for them to try to rebuild their lives in private.  Rev. Sharpton has done a wonderful job of highlighting the racial dimensions of this highly unfortunate incident.  At this point, the conversation about black men in the justice system must grow beyond Trayvon Martin, and the prosecution should be allowed to do its work.  The family, as well all associated racial advocates, need to strategize in private, listen to the evidence and just stop talking.
In other words, thanks for letting the professional race-baiters like Al Sharpton use your son, but his death has now served our purpose, so please shut up.

1. He is NOT a murderer. He is an ACCUSED murderer.

2. Murder is a defined term. It is the unlawful taking of a human life.

3. In Florida, the win a second degree murder conviction, the prosecutor most prove ALL of the following elements beyond a reasonable doubt:

A. A person is killed
B. Without any premeditated design
C. By an act imminently dangerous to another
D. Evincing a depraved mind
E. Showing no regard for human life.

ALL 5 elements must be proven beyond a reasonable doubt.

The following are defences that will allow a defendant to prevail over the prosecution:

A. The death occurred when you fought back or resisted an attack

B. If the death occurred when you were defending another person, especially if that person is a member of a protected class

C. Someone is trying to murder you and you fight back

D. When someone is killed while attempting to commit a felony upon your dwelling.

Any of the above, beats a 2nd degree murder charge.

Also, many 2nd degree murder charges in Florida fall because the Prosecutor cannot demonstrate evidence that the defendant actions "evinced a depraved mind," which is why a case similar to the Zimmerman-Martin case (but the shooter is black and the dead man was white) was charged as a manslaughter case and it is not a slam-dunk for the prosecution.
